Comedians Eric André and Clayton English sued Clayton County police, saying their rights were
violated when they were stopped and questioned about drugs on a jet bridge at Atlanta’s airport.
Both men, who are Black, said they felt they had no choice but to show their ID and let police search
their bags, even though they had already gone through security. Their lawsuit claimed the police
stopped Black passengers more often than others.
At first, a judge dismissed their lawsuit, but a federal appeals court recently brought it back. The
court said that André and English did have a strong enough argument that their Fourth Amendment
rights were violated because the police made them feel like they couldn’t leave. However, the court
did not agree that the stops were proven to be racially motivated. Now, their case against the county
will move forward, showing that police can’t just search or stop people without a good reason.
